This prospectus should tell you: - What kind of franchise it is and what type of agreement you will have with the franchisor. - Who the Directors are and what business experience they have. - The company’s financial track record. - Start-up costs and any other costs to be paid by the franchisee (you). - Any restrictions on activities of the franchisee. - Success rates and numbers of current franchisees. - What kind of training and support the franchisor will provide. - What rights the franchisor has to choose or approve sites for your business. - Terms of the business agreement in regards to termination and renewal procedures. - Financial information about original company location. - Banking information and professional associate list.
Questions to ask the franchisor: - How long have they been in business? How long have they been franchising? - Can you talk to existing franchisees to ask questions about the business? - Where does their main source of revenue come from? - What financial state is the company in? Ask for bank references. - What territory can you operate in? Do you have exclusive rights to that area? - Is training included? - What are the advertising terms and conditions? - What are the ongoing royalties and service costs? - What capital is required and what are the realistic profit projections? - How many other franchisees are there? - Do they have any legal cases against them? - How long will the franchise agreements last?
This list is not exhaustive. Ask as many questions as you can to ensure you invest your money wisely and have many years of good business relations with your franchisor.

This is the story as I remember it….
After many years working in the UK in the direct selling industry, I looked at a failed business in Australia. It was not the business which had failed, but in my opinion, it was the people who had failed the business. They just didn’t have the right mindset at the top level.
I was travelling around Australia looking to inspire the people of this failed business to re-launch with a new focus, and was heading to Adelaide. Being quite tall, I asked for a seat with extra leg room and was pleasantly surprised when I found out that they had such a seat, and was consequently allocated seat 1A.
I’d only just sat down when the air-hostess approached me and told me there had been a mistake and asked if I could move seats. No one was sitting in seat 1C, so I enquired if it would be OK to move up. She said it would, so I moved along two seats, and thankfully still had the extra legroom. I remember, just as the flight was almost ready to take off, feeling a little smug, thinking that I’d got the whole three seats to myself.
Just as the stewardess was about to close the door, a guy jumped on the plane and plonked himself in seat 1A! My immediate thought was ‘what makes you so special?’, but when I looked up I realised that what made him so special was that he was Richard Branson, a part owner of the airline!
Once I had caught my breath, I wondered what on earth I would talk to him about, if indeed he would even want to talk to the likes of me!
Although Australians are not best known for their love of ‘British poms’, I was amazed when the whole plane of Australians cheered and clapped as they noticed Richard Branson had boarded.
It soon became evident to me why. Richard was confident, warm, cheerful and genuinely interested in my future business plans and goals. He and I chatted away like we had known each other for many years, and I’ll never forget the respect he showed me.
This chance meeting has proved to be one of the greatest inspirations of my life. I decided from that day forward, I was going to treat everybody with the same respect, whether I was dealing with a refuse collector, or the MD of a multinational company. Everybody in the company needs to know that ‘THEY’ are important.
On the back of this ‘mindset’ we have taken a failed business to a business that is currently on track to invoice some $25m (?10 million). Our new business is called ‘Penny Miller Pty Ltd’ and sells household products throughout Australia. (We changed the trade name from Betterware Australia)
We have now started a similar company in New Zealand, and are also looking at other overseas markets.
